Florida has asked a state court to halt OpenAI from developing new AI models without independent safety guardrails. Attorney General James Uthmeier filed the motion for a temporary injunction on Monday in the Highlands County circuit court. The motion is part of a lawsuit Florida filed against OpenAI and Sam Altman in June and also seeks to bar minors in Florida from using ChatGPT. The move matters because it links model development itself, not only product use, to court-ordered safety conditions.

Florida seeks court order to pause OpenAI model development

What Florida demands in Highlands County court

The motion sets out several specific prohibitions for ChatGPT in Florida. The state wants OpenAI barred from collecting data from children under 13 without parental consent and other safeguards, and from misrepresenting the safety, reliability and accuracy of ChatGPT. It also targets the chatbot's human-like manner, including use of first-person language, and asks the court to stop it from prolonging conversations to keep users engaged. In a video on X, Uthmeier summarized the position as "Stop calling it safe. Stop pretending it is human. Stop selling it to kids."

The filing ties the request to a set of incidents involving OpenAI's agents. It cites the Hugging Face breach, an attack on the RubyGems coding service and attempted hacks of US government websites, alongside an agent's access to Australia's Medicare statistics portal. It also points to an Axios report on tens of thousands of incidents under investigation at OpenAI and Anthropic. OpenAI said on Friday it had paused training of its most capable models until it has more safeguards in place, a fact the motion uses to argue that a pause is workable.

The case is proceeding in state court after a dispute over jurisdiction. OpenAI had moved Florida's lawsuit to federal court, but a judge sent it back to state court this month, according to The Washington Sun. OpenAI spokesperson Drew Pusateri told Politico that the company wants to work with Florida and other states on rules for the whole industry, adding that those rules should not target one company. He said, in paraphrase, that public confidence in safe AI development starts with the actions of companies such as OpenAI. The motion calls the request unusual, saying the defendants have publicly endorsed restraint and asked the government to tie them to the mast.

What this means for companies using AI

For businesses that rely on ChatGPT or OpenAI models, the immediate issue is continuity of access and product behavior. If the court bars minors in Florida from using ChatGPT or restricts data collection from children under 13, age controls, consent flows and account management will need to change for services built on the product. Limits on first-person language and engagement-driven conversation design could alter support bots, sales assistants and tutoring tools that use a human-like tone. Larger firms will absorb such adjustments through compliance teams, while smaller firms with a single-vendor setup will feel any change in availability or functionality faster.

The motion does not establish new safety standards by itself, and several points still need court review. It is unclear what would count as independent safety guardrails, who would set them, and how a halt on new model development would be scoped and enforced. The cited agent incidents and the reported tens of thousands of cases under investigation describe concerns under review, not final findings about causes or responsibility. Vendors should be asked which model version is in use, what logging and incident review exists for agent actions, and how age restrictions and data-consent controls are implemented in Florida deployments.

The marker to watch is the Highlands County court's decision on the temporary injunction and its exact wording. A narrow order focused on minors and marketing claims would signal product-level compliance work, while any restriction on model development would signal a wider precedent for AI operations. OpenAI's next step on its training pause will show how the company defines sufficient safeguards.
